Credit Score Terms of Use

This document is made for EQX Analytics Private Limited ("Stashfin"), along with the relevant Privacy Policy and the Terms of Use, describes Stashfin's relationship with you.

Kindly read these terms carefully in order to understand how You (as a user), can use our services.

Please read the following important provisions carefully before using this Service to complete the authorization process to www.stashfin.com or Stashfin Mobile App (collectively "Website"). By accessing or using this service or visiting our Website, verifying your mobile number through a one-time password on each access and clicking on "Get Report" you agree and accept to be bound by these terms and conditions and disclaimers set out herein:

1. Credit Information Report Service
   • Stashfin Credit Score Service ("Service") is an online service that enables you to access your credit score and credit report as supplied by our credit bureaus partners ("Credit bureaus"/ "Credit Information Companies"). The Service consists of receipt of your credit report and credit score.
2. Terms of Registration and Authorization
   • You agree that by submitting your details on this Website and requesting the Service, you provide express and voluntary written consent to Stashfin, authorizing and appointing Stashfin as your lawful representative, for the purposes, including but not limited to instruct the Credit bureaus, its affiliates, to obtain, receive and compile your credit information i.e. free credit reports and credit scores, from the Credit bureaus on your behalf, viewing your credit report containing your personal and financial information and use it in the manner consistent with these Terms of Service.
   • You agree that this Service is provided to help you better understand your credit information and provide you with personalized offers for products and services from Stashfin, and/or its business/marketing partners.
   • Further, you hereby expressly grant consent to Stashfin to direct, the Credit bureaus to deliver and/or transfer your credit report to Stashfin on your behalf.
   • You also agree that your authorization can be automatically assigned to a Credit Bureau(s), and this Service shall be provided to you based on your individual consent, in accordance with the arrangement between you and Stashfin, and/or in a manner consistent with the terms and conditions of the arrangement between Stashfin and its Credit Bureau partners.
   • You understand that while requesting for your credit report, Stashfin may and/or may not charge you, at its sole discretion, for such report as well as the other services such as assisting you to understand your credit report etc. Such charges may be revised solely by Stashfin, from time to time.
   • You agree that Additional Standard terms and conditions of the Credit bureaus CIBIL / CRIF Highmark will apply to your use of this Service.
   • You hereby authorize Stashfin to do all of the following in connection with providing you the Services:
     • Verify your identity and share with Credit bureaus certain personally identifiable information e.g. name, PAN etc. about you;
     • Request and receive your credit report, and credit score from Credit bureaus, including but not limited to a copy of your consumer credit report including credit score, at any time for (i) a limited period of six months or (ii) till such time the credit information is required to be retained to satisfy the purpose for which it was provided or (iii) until you withdraw your consent to store such Consumer Credit Information; whichever is earlier and/or as per applicable governing laws and thereafter, the stored Consumer Credit Information shall be deleted, purged or expunged by the Company. Retain a copy of your credit information as per applicable governing laws, along with the other information you have given us access under this authorization, for use in accordance with terms and conditions of this Service, Stashfin's terms of use and Privacy Policy.
     • To assign/transfer your authorization to different Credit bureaus, in any circumstance whatsoever, and accordingly provide credit report from such Credit bureau(s). The consent provided by you at the time of registration under these Terms of Service shall be valid for all Credit bureau(s) partnered with us.
     • For obtaining your credit report, you agree that Stashfin can reapply, to the Credit bureau(s) through multiple attempts, in order to provide you with your credit report. In the event Stashfin is unable to obtain your credit report, for any reason whatsoever, you agree and acknowledge that you shall not hold Stashfin liable in any manner. You understand and acknowledge that in the event Stashfin is unable to obtain your credit report, for any reason whatsoever Stashfin's right to reapply to obtain your credit report shall be valid for a period of 6 (six) months from the date you have applied on the Website for availing this Service, where you had provided consent to Stashfin for directing the Credit bureaus to deliver and/or transfer your credit information to Stashfin on your behalf.
3. Information Accessibility
   • In the course of providing this Service, we collect and process the following information about you-
   • At the time of registration:
     • Gender
     • Name
     • Email Address
     • Date of Birth
     • Phone Number
     • PAN
     • Address
     • Income details
     • Employer details
   • We obtain your credit report (including your score and information) from Credit bureaus on your behalf
   • To understand more about the information, we collect and/or obtain and how we use it, please go through the Privacy Policy.
4. How we use your credit information
   • We process and use your credit information in the following ways: -
   • To present you an overview of your credit profile including detailed information of all your credit accounts, where available;
   • To provide assistance to you to understand your credit report and help you with other ancillary services which may include credit assessment services and rectification services etc, as applicable. Such ancillary services, if any, shall be governed by their respective terms and conditions including these Terms of Service;
   • To provide you with customized recommendations and personalized offers of the products and services of Stashfin and/or its business partners/ affiliates via email, text, call or online display or other modes/channels at the sole discretion of Stashfin;
   • To aggregate anonymous data for the purpose of data analytics, reporting, historical or comparative information or insights about your credit data, through third parties, in accordance with applicable laws;
   • To present you with reward / loyalty programs of Stashfin from time to time and when you avail these programs, then you shall be bound by their respective terms and conditions (which shall be notified from time to time);
   • To ensure that you have the best online experience on the Website.
5. Your Stashfin Credit Information Account
   • Eligibility: To avail of the Service, you must register on the Website and create an account. By registering with Stashfin for this Service, you agree and certify that:
     • You are 18 years of age or above;
     • Any information you provide to us, both when you register and, in the future, is and will be true, accurate, current and complete;
     • You are only registering an account for yourself and agree not to use this Service to attempt to obtain/receive credit information about any other person than you;
     • You will keep all information up to date;
     • You have registered voluntarily and Stashfin has not made any promises or representations to you in order to induce you to provide your credit information or seek any consent or authorization in this regard.
   • Option to "Unsubscribe" from your credit information account
     • The authorization granted by you is effective until your credit information account section, is unsubscribed by either you or Stashfin and you discontinue all use of our Service and in accordance with these Terms of Service.
     • An "unsubscribe" facility will be provided on the Website, through the customer service option, in order to provide you with an option to unsubscribe from this Service. By availing it, we will discontinue to provide you with these Services and you shall not receive future updates/monthly refreshes on your credit information/credit report/credit score and you will be able to view only historic information, if any, "as is" related to your Stashfin credit information account section of "My Account". Stashfin shall not be requesting for any future credit reports from Credit bureaus.
   • Request to "Delete" your credit information account: We strongly advise you to continue with this Service because it helps you to monitor your credit report and score regularly and take informed credit decisions. However, if you still wish to delete your credit information account, please refer to the FAQ section of your credit information account or send an email request to us for deletion of your credit information. On receiving your request for deletion, we will erase your data, discontinue sharing monthly report refreshes and we will not send you any further communications in this context. You understand that by requesting to delete from this Service, we will only delete your Stashfin credit information account section from your "My Account" and your "My Account" with Stashfin for your other products and services, if you have opted, shall continue to be valid, subject to the terms specified under "My Account" as stated under the terms of use.
   • Credit Information Consent Management: You hereby authorize Stashfin to continue providing you uninterrupted access to credit information from Credit Bureaus CIBIL / CRIF Highmark. By logging into your Stashfin account, you grant Stashfin the right to access your credit information for the next 6 months and/or as per applicable governing laws.
   • Stashfin reserves the right to refuse service, terminate or remove accounts in its sole discretion. Notwithstanding the above, we retain the right at our sole discretion to deny access to anyone to the Website and this Service we offer, at any time and for any reason, including, but not limited to, for violation of these terms of use and/or Privacy Policy, including additional standard terms and conditions of the Credit bureaus. Upon termination, your right and license to access and/or use the Service immediately ceases; your User ID will be deactivated and you will no longer be able to access or use the Service.
   • Notwithstanding the foregoing, any section of these Terms of Service that by its nature is intended to survive termination of these Terms of Service or your use or access to our Services or will survive such termination.
6. Disclaimer of Warranties
   • This Service is intended to provide helpful and informative material on the subjects addressed.
   • Stashfin does not control your credit report and credit score, which is a statistical analysis of information contained in your credit file as maintained in the system and database of Credit bureaus, and we cannot change that information for you.
   • If information in your credit report is inaccurate and is affecting your credit score, you have the right to dispute it either by directly contacting the Credit Bureau(s), through their website, or by contacting us at Stashfin. INFORMATION AND/OR SERVICES OFFERED ON THIS WEBSITE ARE PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND, INCLUDING WARRANTIES OF CORRECTNESS, COMPLETENESS, ACCURACY MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. IN NO EVENT WILL STASHFIN BE LIABLE TO ANY PARTY FOR ANY DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THIS WEBSITE, OR ANY LINKED WEBSITE, INCLUDING WITHOUT LIMITATION, LOST PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, OR OTHER ECONOMIC LOSSES, LOSS OF PROGRAMS OR OTHER DATA, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER ACTION, EVEN IF STASHFIN IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. Limitations and Restrictions on the Use of Service
   • You agree to provide true, accurate and current information such as your full name, date of birth and address of residency etc, to us. The Service provided herein is subject to you providing true and accurate information and providing all the required documents as requested by Stashfin. Each Service request is for one person only; We do not accept joint request for this Service.
   • A Service request may be rejected by the Credit bureaus in the following events:
     • The particulars furnished by you do not match the information existing with the Credit bureaus;
     • Data rejected by the data collection system maintained by Credit bureaus;
     • Incomplete upload of data provided by you in relation to this Service. Stashfin shall inform you of such rejection.
   • Any analysis and estimates we provide as part of our Service are for illustrative and informational purposes only. Our analysis and estimates are based on certain assumptions and use only the data we have. Our analysis and estimates are neither endorsed by, nor commissioned by, any of our affiliates.
   • The methodology we use to determine which offers, analysis, or other information is presented or highlighted is proprietary and we may elect to consider, ignore, emphasize, or de-emphasize certain factors in our sole and absolute discretion.
   • We do not guarantee that the information we present as part of our Service, including credit report or credit score information, is the same information that may be used or reviewed by a third party to assess your creditworthiness or eligibility for any particular product or service.
8. Confidentiality
   • Since it affects your use of the Service, please review our terms of use and Privacy Policy.
   • We collect, use and disclose information about you as provided in our Privacy Policy and described herein. Our Privacy Policy is located on the Website and is incorporated into these Terms of Service by way of reference, and you agree to accept the terms of such Privacy Policy as a condition to your acceptance of these Terms of Service.
9. Indemnification
   • You agree to indemnify, defend and hold harmless Stashfin and its affiliates, and their respective officers, directors, employees, agents, licensors and suppliers, and any third party providers of information to this Service, from and against any and all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from your violation of these Terms of Service or any terms and conditions applicable to Service, or your violation of the intellectual property rights of Stashfin, Credit bureaus, or any of those other parties.
   • You shall not sue or otherwise make or present any demand or claim, and irrevocably, unconditionally and entirely release, waive and forever discharge Stashfin, its officers, directors, employees, agents, licensees, affiliates, successors and assigns, jointly and individually (hereinafter "Releasee"), from any and all manner of liabilities, claims, demands, losses, claims, suits, costs and expenses (including court costs and reasonable attorney fees) ("Losses"), whatsoever, in law or equity, whether known or unknown, which you ever had, now have, or in the future may have against the Releasee with respect to the submission of your credit information and / or your decision to provide Stashfin with the authority to deliver your credit information under this Service. You agree to defend, indemnify, and hold harmless the Releasee from and against any and all Losses resulting from claims made against Stashfin and the Credit bureaus by third parties arising from and in connection with this authorization.
10. Links to Other Websites
    • For purposes of convenience, this Service of Stashfin may contain links to third party websites. Stashfin makes no representations or warranties about any third-party websites that you may access through the links. By providing a link to those websites, Stashfin does not endorse, adopt, or otherwise accept any responsibility for the content or use of those websites.
11. Compliance, Applicable laws and Jurisdiction
    • You must comply with all applicable laws when using our Service. You are not permitted to use our Service to obtain any consumer credit report, score or other consumer credit information under false pretence(s) or in violation of applicable laws.
    • These Terms of Service shall be governed by and understood in accordance with laws of India and Courts in the city of New Delhi (Delhi High Court and Saket District Court) will have exclusive jurisdiction in regard to any dispute arising thereof.
12. Other Terms and Conditions
    • The terms and conditions mentioned herein may be modified by Stashfin in its sole discretion from time to time.
    • The rights granted in these Terms of Service are personal. You may not assign, sub-license or otherwise transfer any of your rights under these conditions.
    • If a court finds any part of these Terms of Service to be invalid, the remaining parts of these Terms of Service shall continue unaffected.
    • If either of us fails to exercise any right or legal remedy available to either you or us any such failure shall not prevent you or us from relying on these at a later date.
    • Headings in these Terms of Service are for convenience only and will have no legal meaning or effect.
    • In addition, use of this Service shall also be governed by the terms of use and Privacy Policy of our Website.
